WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HARBORLINE AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS (USD $100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.

10. Indemnification
You agree to defend, indemnify, and hold harmless Harborline and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms.
11. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Except where prohibited, you agree that exclusive jurisdiction for disputes relating to these Terms or the Site lies in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction there.
Informal resolution. Before filing a claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
12. Changes
We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Continued use after changes constitutes acceptance. Material changes may also be noted on the Site homepage.
13. Termination
We may suspend or terminate access to the Site at any time, with or without notice, for conduct we believe violates these Terms or harms other users or Harborline.
14. Severability
If any provision is held unenforceable, the remaining provisions remain in effect.
